Liability Waiver
Please ensure all guests and visitors sign below before entering the property.
By accessing this page, you acknowledge that all guests visiting the property must sign the waiver below. Any individual who fails to do so is considered a trespasser with no legal right to be on the premises.
Waiver, Release of Liability, and Assumption of Risk
I assume all risk of injury while participating in the rental and use of the property and its facilities, including the pool and/or hot tub, belonging to OASIS LLC and all members associated with the home (collectively, the "Released Parties"), and as consideration for the right to participate (the "Activity"), I execute this Release of Liability and Assumption of Risk ("Release"), binding my heirs, executors, administrators, personal representatives, next of kin, and assigns.
I hereby release, waive, and discharge the Released Parties, including their officers, agents, and employees, from any and all claims, causes of action, demands, costs, or damages — including those arising from negligence — resulting from property damage, personal injury, or death sustained by me while participating in the Activity.
I further agree to indemnify and hold harmless the Released Parties from any liability, claim, damage, or judgment incurred as a result of any act or omission by me while participating in the Activity.
I AM VOLUNTARILY PARTICIPATING IN THIS ACTIVITY ENTIRELY AT MY OWN RISK. I am aware that risks may include, but are not limited to, physical or psychological injury, illness, disability (including paralysis), economic or emotional loss, and death — arising from my own or others' negligence, travel conditions, wildlife, weather, terrain, equipment, or the condition of the Activity location. I assume all related risks, known and unknown.
I acknowledge and agree to the following:
I am not an agent, servant, or employee of OASIS LLC and am not covered by its insurance policies.
The use of a swimming pool or hot tub may place me and my guests in foreseeable and unforeseeable positions of danger. I release the Released Parties of any duty to protect me and voluntarily assume all risk under any circumstances that may arise.
My participation in this Activity is a privilege subject to revocation at any time by OASIS LLC.
This Release extends to any minor children in my custody and control.
In the event I require medical care, I agree to be financially responsible for all costs incurred and understand I should carry my own health insurance.
In the event of damage to equipment or facilities caused by my or my family's willful actions, neglect, or recklessness, I agree to be held liable for all associated costs.
The Released Parties are not responsible for errors, omissions, or failures to act by any party conducting a specific event or activity on their behalf.
This Release is intended to be as broad and inclusive as permitted by the laws of the State of Texas. If any portion is found invalid or unenforceable, the remainder shall remain in full force and effect. Venue for any litigation shall be in Travis County, Texas.
Any controversy or claim arising from this rental agreement shall be settled by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association.
BY SIGNING BELOW, I ACKNOWLEDGE THAT I HAVE READ AND FULLY UNDERSTAND THIS WAIVER, RELEASE OF LIABILITY, AND ASSUMPTION OF RISK. I VOLUNTARILY WAIVE ANY RIGHT TO BRING A LEGAL ACTION AGAINST OASIS LLC AND ALL MEMBERS ASSOCIATED WITH THE HOME FOR PERSONAL INJURY OR PROPERTY DAMAGE.
